GENERAL TERMS AND CONDITIONS OF SALES

ARTICLE 1 β€” GENERAL PROVISIONS

These General Terms and Conditions of Sale ("T&Cs") govern transactions made on the Tias, Cedric Wolf website https://www.mimilights.com/ (hereinafter the "Website Operator" or "Operator").

By placing an order on the Website, the Customer acknowledges having read and accepted these T&Cs by ticking a checkbox or clicking a dedicated button before finalizing the purchase.

The applicable T&Cs are those in effect at the time of order placement. The Operator commits to archiving these T&Cs and making them available to Customers upon request.


ARTICLE 2 β€” PRODUCT DESCRIPTION

The Website offers online sales of clothing (hereinafter referred to as "Product(s)"). These Products are available to all customers, whether individuals or businesses.

Each Product is presented with a detailed description (materials, sizes, colors, care instructions) provided by the Operator. Product images are for illustrative purposes only and may differ slightly from the actual product.

The Customer is responsible for ensuring they have a secure and suitable device to access the Website. The Operator is not responsible for any technical issues related to the Customer’s internet connection or device.


ARTICLE 3 β€” ORDERS

Orders are accepted subject to stock availability. If an ordered Product becomes unavailable after purchase, the Customer will be informed as soon as possible by email. The Customer may then choose:
βœ” A replacement Product of equal quality and price, or
βœ” A full refund, including shipping fees, processed within 30 days of payment.

Once confirmed, orders are firm and final, except as provided in the return policy (Article 9).


ARTICLE 4 β€” PAYMENT TERMS

Placing an order on the Website constitutes a financial commitment. Payments are processed via Shopify Payments, which supports multiple methods such as:

ARTICLE 5 β€” PRICING AND PAYMENT

βœ” Prices are displayed in CAD (Canadian Dollars) and include applicable taxes.
βœ” The total price, including taxes and shipping fees, is indicated before order confirmation.
βœ” Discounts and promotional offers apply only during the indicated period.

Payment is required in full at checkout. No order will be processed before full payment confirmation.


ARTICLE 6 β€” CONTRACT FORMATION

The contract is considered valid as soon as the Customer:
1️⃣ Selects their Products and adds them to the cart.
2️⃣ Reviews their order and accepts these T&Cs.
3️⃣ Proceeds to payment and confirms their purchase.

This "double-click" process constitutes an electronic signature with the same legal value as a handwritten signature.

The Operator commits to securely storing order records and invoices as legal proof of transactions.


ARTICLE 7 β€” RETENTION OF OWNERSHIP

The Operator remains the owner of the Products until full payment is received, including shipping costs.

In case of non-payment or chargeback, the Operator reserves the right to cancel the order and claim the return of the Products at the Customer’s expense.


ARTICLE 8 β€” SHIPPING AND DELIVERY

βœ” Orders are shipped within 7 to 10 business days from the date of purchase.
βœ” Delivery time may vary depending on location, carrier processing times, and holidays.
βœ” The Customer is responsible for providing an accurate and complete shipping address.

The Operator is not responsible for delays caused by:
βœ” Incorrect shipping information provided by the Customer.
βœ” Unforeseen circumstances (e.g., weather, strikes, customs delays).

If a package is returned due to an incorrect or incomplete address, the Customer may be required to cover the cost of reshipping.


ARTICLE 9 β€” RETURNS AND REFUND POLICY

9.1 Return Conditions

The Customer has 30 days from the receipt of the Product to request a return.

To be eligible for a refund:
βœ” The item must be unused, unwashed, and in its original condition.
βœ” It must include original packaging, tags, and accessories (if applicable).
βœ” A proof of purchase (invoice or order number) must be provided.

9.2 Return Shipping Costs

βœ” If the return is due to an error by the Operator (wrong item, defective product): The Operator will cover all return shipping costs.
βœ” If the return is for any other reason (change of mind, wrong size): The Customer must cover the return shipping fees.

9.3 Refund Process

9.4 Non-Refundable Products

The following items cannot be returned:

❌ Items that have been worn, washed, or altered
❌ Final sale or clearance items

The Operator reserves the right to refuse any return that does not comply with these conditions.

All content on the Website, including:

βœ” Product descriptions and marketing materials

Are the exclusive property of Mimilights Inc. and cannot be copied, modified, or redistributed without permission.

Customers may share product images on social media for promotional purposes but may not claim ownership or resell them.


ARTICLE 13 β€” MODIFICATIONS TO THE TERMS

The Operator reserves the right to modify these T&Cs at any time. Changes apply to new orders but do not affect previous purchases.
